GAO was requested to comment on the offer of a plaintiff to settle in a pending court case. In a decision GAO denied the plaintiff's request for relief from a mistake in bid alleged after the award was made. The decision considered and rejected the contention that the contract was unenforceable or unconscionable. GAO believed that the compromise offer in the pending case was only a repetition of the arguments previously rejected, and that the equities mentioned by the plaintiff were of little consequence. Since the settlement offer did not represent a significant compromise, GAO saw no reason to accept it.
