Highlights

A request was made for an advance decision as to whether a State employee, after a temporary assignment to a Federal agency, could be reimbursed for travel and transportation costs for himself, his dependents, and household goods to a location other than that of his previous position. The employee had accepted a position in another locality and moved there upon the termination of the Federal assignment. It was held that the costs of moving the household goods and dependent travel could be reimbursed, but not to exceed the constructive costs of the return to the location of his previous position. It was also held that since the employee was not required by any regulation or the terms of his assignment agreement to return to his previous position, his own travel costs could be reimbursed to the same extent.
