An employee requested reconsideration of a Claims Division decision which denied his claim for a retroactive temporary promotion and backpay. The record showed that although the employee performed some of the duties of the higher graded position, he was not detailed to that position. The description of the position he held stated that he must be capable of assuming the duties of the higher position and act in that capacity when directed or when the person in that position was absent from his duty station. Thus, the employee was acting within the confines of the position to which he was appointed. Additionally, the record showed that the employee did not meet the legal requirements for promotion established by Civil Service Commmission regulations. Therefore, he would not be qualified for the higher graded position, and the disallowance of his claim was sustained.
