Highlights

A company protested a contract award on the grounds that the awardee was not a small business and had not affirmatively demonstrated its responsibility. The company also protested the correction of the awardee's bid after bid opening. The protest that the awardee was not a small business was denied because an amendment to the invitation for bids (IFB) withdrew the small business set-aside. GAO does not consider protests of affirmative determination of responsibility where the protester does not allege fraud on the part of procurement officials or noncompliance with IFB definitive responsibility criteria. The protest of correction of the bid after bid opening was denied since the correction involved the omission of a figure required by the IFB for evaluation purposes only and did not affect the price to which the awardee was entitled under the contract. Accordingly, the protest was dismissed in part and denied in part.
