Entitlement to Retroactive Temporary Promotion With Backpay for Extended Detail

An employee appealed the determination that he was not entitled to receive a retroactive temporary promotion with backpay for an extended detail. The employee did not submit documentation to support his claim, but he did submit statements from his foremen that he functioned in that position during the relevant period. In denying his claim, the agency stated that he had not performed the full range of duties of the position, and that his detail had not been verified by an agency official; GAO disallowed the claim for the same reasons. After reviewing the materials submitted by the employee, GAO found them insufficient to support his claim. Regulations provide that claims are decided on the written record before GAO, and the burden is on the claimant to prove all elements of his claim. Since the employee did not supply sufficient documentation to demonstrate that he was detailed to a higher-graded position, the disallowance of his claim was sustained.
