Highlights

An appeal was made of a denial for waiver by a Navy member of a claim against him arising out of erroneous payments of basic allowances for quarters and station housing allowance. The records showed that the member was assigned to Government quarters while stationed at Kaneohe, Hawaii which should have terminated his entitlement to basic allowance for quarters and housing. However, due to an administrative error, payments were continued for a substantial period resulting in the member's indebtedness. Although the member stated that he made inquiries concerning the correctness of his pay, it cannot be held that he was without fault since the amount was substantial and he should have pursued his inquiries. The previous decision denying the claim for waiver was sustained.
