A firm protested a sole-source contract award by the Naval Air Systems Command. The protester stated that although the cancellation of the improper award was not now practicable, an expression of disapproval of the award was in order to prevent the issuance of future sole-source contracts. A sole-source contract award under public exigency exception cannot be questioned when the number of items to be procured under contract have been justified, no other firm can meet needed delivery schedule, and the price or cost analysis of proposed contract price is consistent with regulatory requirements given circumstances requiring urgent award. The protest questioning issuance and method of two-step procurement, in which the protester participated, was untimely filed. The protest was denied.
