A firm protested the proposed award of a contract to another firm by the Tennessee Valley Authority (TVA), alleging that the proposed awardee had not submitted a bid responsive to the commercial and technical requirements of the invitation for bids. GAO is precluded by U.S. statute from disallowing credit for any expenditure determined by the TVA Board to be necessary to carry out the Tennessee Valley Authority Act. GAO, therefore, refrained from considering the protest because it could not effect any remedial action, and the protest was dismissed.
