A cooperative student employee of the National Labor Relations Board (NLRB), found to be at fault in an automobile accident and not insured, submitted a claim for damages under the Military Personnel and Civilian Employees' Claims Act. The other participant in the accident filed a claim with NLRB under the Federal Tort CLaims Act and was compensated. For the purposes of the Federal Tort Claims Act, the employee was found to be negligent; consequently, she was negligent for purposes of the Military Personnel and Civilian Employees' Claims Act. Claim for damages was denied.
