A retired member's wife appealed the denial of her claim for her husband's retired pay accruing during a 7-year period from the date of his disappearance to the date he was declared dead by a State court. The claim may not be allowed since retired pay is payable only during the member's life, and the court determination of death was presumptive only and did not establish that the member lived for 7 years.
