Highlights

The plaintiff in a wrongful death action requested reconsideration of a settlement disallowing interest on the judgment awarded to her. The judgment was subject to interest limitations in 31 U.S.C 724a for amounts less than $100,000; however, 31 U.S.C. 724a provides for compensation to a successful plaintiff whose judgment payment was delayed solely because the United States appealed and lost. Interest may be allowed in this case because the Government filed a notice of appeal and did not pursue it.
