Protest regarding Responsiveness to Labor Surplus Area Concerns Requirement

The protester contended that it was the only bidder responsive to the labor surplus area concern requirement in the solicitation since it was the only "Certified Eligible Concern" which submitted a bid. However, in accordance with recent statutory and regulatory changes, the solicitation did not distinguish between "certified eligible" and other labor surplus area concerns. Therefore, the fact that the protester was a certified eligible firm was of no consequence since it was not the low bidder.
