A company protested that the Government of the Phillippines refused to approve a labor agreement with anyone other than the awardee and, as a result, the contract was awarded at a price higher than the protester had bid. The claim was denied because the record indicated that the procuring agency did not know of the Government's decision until after bids were submitted. The protester was found to be nonresponsible, and the award was made to the lowest responsible bidder. The agency did not arbitrarily or capriciously deny the contract to the protester; the protester's claim for proposal preparation costs was also denied.
