A company requested relief for alleged mistakes in its bid on the basis of which it was awarded contracts which were later terminated for default. GAO was not bound in this issue by a decision of the Armed Services Board of Contract Appeals. The request was denied because: the bidder did not take exception to the alleged mistake until after the award; the solicitation provided for the Government's right to make multiple awards, and the agency's request for extensions of the bid acceptance period were not inconsistent with this provision; the bidder's misinterpretation of the provision was a unilateral error on the part of the bidder of which the agency was not aware before award; and the bidder's statement to a preaward survey team concerning unacceptability of the partial award was not communicated to the contracting officer before award and did not serve as constructive notice of a mistake.
