Restoration of Positions and Backpay for Demoted Employees

A decision was requested concerning the legality of a proposed personnel action to restore employees with backpay to positions from which they had been removed pursuant to a court order. Since a subsequent court order permitted the agency to take whatever personnel action it found appropriate, including reinstatement, backpay may be paid if the agency determines that removal was unjustified.
