A protester to a contract award contended that the awardee's bid was nonresponsive and that award of the contract after notice of protest violated regulations. Matters relating to the awardee's ability to meet licensing requirements and its capacity to perform involved questions of responsibility, not responsiveness, and were not reviewed. Although the agency failed to comply with a procedural requirement in making the award after it was on notice of protest, the validity of the award was not affected.
