Protest Involving Sole-Source Procurement, Contract Price, and First Article Approval Requirement
Highlights
A company protested against four procurements, alleging that sole source procurement was unwarranted, that the contract price was unreasonablly high, and that the procuring activity arbitrarily refused to waive the first article approval requirement. The protest against the procurement procedures was untimely since it was filed several months after the protester learned of sole source negotiations, the contract price was published, and the protester received notice of the first article approval requirement. Waiver of first article testing was within the discretion of the procuring activity, and there was no showing that the requirement was arbitrary. The reasonableness of testing procedures employed after award was a matter of contract administration.
