Protest to Rejection of Bid for Failure To Acknowledge Amendment

A company protested the rejection of its bid for failure to acknowledge a material amendment, stating that it never received the amendment and requesting cancellation and resolicitation of the solicitation. The procurement cannot be resolicited since failure to receive the amendment was not the result of a deliberate effort by the agency to preclude the bidder from competiton, and the procurement activity does not insure delivery.
