A grievance examiner found that an associate professor at the Merchant Marine Academy should have been promoted if his request for promotion had been approved in a timely manner and recommended that the employee be promoted retroactively. The employee did not have any statutory or regulatory right to be promoted, and there was no indication of nondiscretionary administrative regulation or policy concerning promotions. Retroactive promotion was denied.
