Defense Contract Administration Services Region Atlanta of the Defense Logistics Agency questioned whether a discount taken on payments under a contract must be refunded. Although the contract included inconsistent provisions concerning the discount period, the contractor intended only to offer the discount on its own terms. The provisions inserted in the contract by the company must prevail, and the discounts taken by the Government must be returned.
