Protest to Sole Source Procurement

A company protested sole source procurement contending that it offered a superior and less expensive product. It also claimed patent infringement and contested ownership of item. The contracting officer's determination, based on regulations and delivery schedule, was reasonable. Questions of patent rights are for court or administrative settlement and the contractor's right to offer the item is a question between private parties.
