Policy to Decline to Rule on Cases under Litigation in Courts

Modular Devices, Inc. protested the rejection of its bid to NASA and the award of a contract to a higher bidder. Modular filed an action in U.S. Court seeking a judgment for damages to reputation and loss of profit. It is GAO policy to decline to rule on issues involved in court litigation.
