Retroactive Compensation

An Authorized Certifying Officer, National Oceanic and Atmospheric Administration, requested a decision as to whether two of its merchant seamen could claim retroactive pay for services rendered after effective date of pay increase, notwithstanding their separation before that date. Claims were paid, as it is maritime industry practice to make such payments and contrary provisions of U.S. Code do not apply to seamen.
