A Federal employee claimed reimbursement of real estate expenses incident to the first of two relocations. The employee was separated by a reduction in force by the National Aeronautics and Space Administration (NASA) and employed after a break in service of less than 1 month under a term appointment with the Department of Health, Education, and Welfare (HEW). The employee may be reimbursed for the expenses of selling his residence at the NASA duty station since the term appointment with HEW was a "nontemporary appointment." The Army, which subsequently employed the claimant, was not liable for the expenses since the eligibility for reimbursement arose incident to the reduction in force by NASA and employment by HEW.
