Protest Against Award to Low Bidder

The protester objected to the proposed award of a contract to the low bidder, contending that the low bid should have been rejected as nonresponsive for failure to comply with the solicitation requirement for listing of suppliers. Although the requirement was not fully met by the low bidder who listed two possible suppliers, the award may be made to the low bidder. The listing requirement was inadvertently included in the solicitation, and the second low bidder who fully complied with the requirement was not prejudiced thereby.
