Coverage Under Judicial Survivors' Annuity System

A decision was requested concerning coverage of a U.S. District Court judge in the Canal Zone under the Judicial Survivors Annuity System (JSAS). Since the judge did not elect coverage under JSAS within 6 months of taking office or becoming married, he was precluded from doing so at a later date. The judge could have elected to be covered by JSAS in 1962 under 28 U.S.C. 376, but since he served more than 10 years, he did not qualify for exclusion from the refund provisions of 28 U.S.C. 376.
