The protester objected to the award of a contract, contending that the bids of the two lowest offerors should be rejected as nonresponsive for failure to properly execute the labor surplus area eligibility certificate. Under the labor surplus area provision of the solicitation, the bidder's stated percentage of costs (100 percent) to be incurred in the labor surplus area was changed after bid opening to 30 percent. This change did not affect its eligibility for award since the bidder agreed prior to award to perform at least the minimum required percentage (25 percent) in the labor surplus area.
