A company protested the contracting officer's failure to terminate two contracts when the awardee was found to be other than a small business. The awardee did not certify itself as a small business in bad faith, and the award was made on the basis of the Small Business Administration's initial determination that the firm was small. It would not be feasible to terminate the contracts, but the Government should not exercise its option to extend the contracts beyond the initial term.
