Roberta C. McKinney appealed the disallowance of her claim for the 6 months death gratuity and unpaid pay and allowances of her late husband. Although she claimed she acted in self-defense, the widow killed her husband and was indicted. She was not entitled to compensation since the lack of felonious intent could not be established. A civil action allowing the proceeds of the member's life insurance to his mother, while not binding on GAO, should be weighed in consideration of survivor claims.
