Payment for Delivery to One Firm for Item Under Contract to Another Firm

A decision was requested as to whether payment may be made to one firm under a delivery order issued pursuant to a contract held by another firm. The product was orally requested by an employee who was without contracting authority, and established small purchase procedures were not followed. However, since the government received the benefit of the product, payment may be made on a quantum valebant basis.
