Two companies requested reconsideration of a prior decision holding that the agency was not required to give preference to a labor surplus area set-aside over a small business set-aside in a procurement where both were appropriate, contending that it was based on a misreading of a temporary regulation. The prior decision was affirmed since no error of fact or law was demonstrated. A request to the agency for a report on the protest did not represent a final GAO decision on merits of contentions raised by the protest.
