Protest Against Rejection of Bid as Nonresponsive for Failure To Acknowledge Amendment

The protester objected to the rejection of its low bid as nonresponsive for failure to acknowledge receipt of an amendment to the solicitation, stating that it never received the amendment. The rejection of the bid for failure to acknowledge the material amendment to the invitation for bids was proper so long as there was no conscious and deliberate effort on the part of the contracting agency to exclude the bidder from competition.
