Effective Date of Retirement

A Federal employee appealed a decision not to grant him retirement as a firefighter under the provisions of Public Law 93-350. The employee, unaware of the liberalized annuity computation formula effective July 12, 1974, was separated for optional retirement effective June 30, 1974. The employee may not be restored to the rolls in order to set the date of retirement on or after July 12, 1974, to take advantage of the liberalized formula in Public Law 93-530 since the separation date was set properly by the agency.
