Remission of Liquidated Damages Under Two Contracts

A contractor requested remission of liquidated damages assessed against it by the agency under two contracts. GAO concurred in the agency's recommendation to remit the liquidated damages assessed under one of the two contracts but denied the similar request under the other contract since the agency recommended against remission, and the Comptroller General may not remit liquidated damages in the absence of a favorable agency recommendation.
