Entitlement to Deceased Military Member's Unpaid Pay and Allowances

Reconsideration was requested of a settlement disallowing the claim of the mother of a deceased member to unpaid pay and allowances due at the time of death. The mother was not entitled to the unpaid pay and allowances since the decedent was survived by a minor child, and under statutory regulations the child stood in a higher order of precedence than the mother of the decedent. Since the child was a minor, the mother of the child may receive payment of the unpaid pay and allowances as the natural guardian of the child for purposes of the applicable statutes.
