The protesters objected to the prospective award of any contract to a company on the basis of a purported deficiency in that company's bid bond. The bid was submitted in the name of an apparent joint venture and was accompanied by a bid bond containing the name of a principal differing from that of one of the parties to the joint venture. The bid was nonresponsive because of the discrepancy, and the defect could not be cured by post-bid opening clarification. Prior sales contracts awarded on the basis of similar nonresponsive bids were legally defective, but corrective action was impractical since the contracts had been performed.
