Reconsideration of Protest Involving Subcontractor Listing Requirement

A company requested reconsideration of a decision denying its protest against a contract award, asserting that it would be prejudiced by the award and that a subcontractor listing requirement should not have been waived. Since the agency reversed its policy of requiring a subcontractor listing by terminating its implementing regulation, a previously authorized deviation from the terminated regulation which permitted the listing of pipe suppliers was also terminated. The protester was not prejudiced by the agency action.
