An advance decision was requested regarding the entitlement of a retired Coast Guard member to pay and allowances as a result of the correction of his military records. A properly constituted Correction Board concluded that a member's records should be corrected but recommended that no corrective action be taken because it would create a substantial new precedent, and the General Counsel, acting through his delegated authority, agreed with the Board's findings and conclusions as to the merits of the case but on a detailed finding that no policy reason existed to deny correction reversed the recommendation to deny correction. Such action was consistent with law and the cases cited. Since the General Counsel had the authority to review and take final action on referrals of findings of the Correction Board, no basis existed to question the member's entitlements to pay and allowances arising from the correction action.
