Claim for Overtime Pay While in a Travel Status

An advance decision was requested with regard to an employee's claim for overtime compensation for work allegedly performed by the employee while in a travel status. The time spent in travel outside of the regular working hours by a wage-grade employee driving a military truck on a return trip from a temporary duty post to his permanent duty station constituted hours of work within the meaning of the Fair Labor Standards Act and entitled him to overtime compensation. However, the employee was not entitled to overtime compensation for the time spent in travel as a passenger in the government vehicle on the return trip, as he performed no actual work during that period.
