Request for Rescission of Contract Award Due to Error in Bid Modification

The contractor requested rescission of its contract, alleging an error in its telegraphic bid modification. The fact that the purchaser's bid modification was about 1.85 times the next high bid and 3.4 times the current market appraisal did not place the contracting officer on constructive notice of a possible error in the bid. Where the solicitation authorized telegraphic bid modifications and the modification was timely received, the bid was properly considered as modified. Therefore, there was no legal basis to rescind the contract.
