Request for Reformation of Contract Due to Omission of Provision

The contractor requested retroactive reformation of a timber sale contract to include the contract provision which was inadvertently omitted at the time of the first extension. The contract may be modified to retroactively incorporate the provisions since the provision should have been included under the terms of an agency directive and since the contract contains a provision for modification of the contract to include provisions which are in general use by the agency.
