Highlights

The contractor requested reformation of a contract to reflect an upward price adjustment in the amount of an error in its bid alleged prior to award of the contract. The contract was awarded subject to final determination of the mistake in bid claim. Since the contractor's evidence left no substantial doubt as to the existence and nature of the mistake and the amount of the intended bid and since the contract was awarded with knowledge of the mistake in bid, reformation of the contract to reflect the claimed increase in price was permitted.
