Request for Reconsideration of Refusal To Consider Untimely Protest

A firm requested reconsideration of a prior decision which held untimely its protest against the cancellation of a solicitation and the subsequent reprocurement of the requirement. The request for reconsideration was denied because the protester filed its protest more than 4 months after a resolicitation was issued, because it believed it had been found nonresponsive. Since the agency had until the date of the award to determine a bidder's responsibility, there was no basis to support the protester's claim that the agency was purposely delaying the contract award in order to allow another bidder to become responsible. Accordingly, the prior decision was affirmed.
