Request by Temporary Employee for Military Leave

A temporary limited employee of the Federal Government appealed the agency's denial of his request for military leave for Army Reserve annual training. Statutory restriction on the eligibility for military leave to "permanent and temporary indefinite" employees of the Federal Government excluded from eligibility the employee who held a temporary appointment for less than 1 year.
