Highlights

A wage grade employee appealed the denial of his claim for hazard pay because the agency contended that 5 U.S.C. 5545(d) only provided hazard pay for classified, not wage grade, employees. The basis for denying the employee's claim was incorrect since the employee's entitlement under Federal Personnel Manual regulations had not been considered. However, the agency subsequently reported that the employee's duties had not entailed hazard duty and, therefore, the employee's claim was still denied.
