Backpay Entitlement Upon Reinstatement After Unjustified Separation Action

Advice was requested concerning computation of backpay resulting from an employee's reinstatement after an unjustified personnel action. Since the employee's lecturing and writing activities did not substantially increase during the period of his separation from Government service, the interim earnings from such activities need not be deducted from his backpay.
