Rejection of High Bid on Timber Sale Due to Export Limitations

Highlights

A firm protested the rejection of its high bid on a timber sale because the agency believed that an award to the protester would be in violation of the timber export and substitution restriction contained in 36 C.F.R. 221.25. The high bid on the timber sale was rejected because the award would have caused the bidder to exceed its export and substitution quota for calendar year 1974. The award, withheld during the pendency of the protest, could be made in 1975 since no quota prohibition existed in 1975.
