Protests Against Evaluation Formula and Improper Wage Determination

A company protested the solicitation's allegedly arbitrary formula for evaluating refunds and the solicitation's failure to include the proper wage determination. The protests were untimely filed after bid opening because protests against solicitation defects must be filed prior to bid opening. Although the agency received the new wage determination after bid opening, the contracting officer should consider the necessity for cancellation of the solicitation and resolicitation on the basis of the new wage rate determination.
