Appeal of Claims Group Settlement for Lost Property

The Army protested a settlement denying setoff charges against a carrier for property allegedly lost during a relocation, contending that the statement of loss on the claim form the shipper submitted established proof of tender. GAO held that the Army failed to provide evidence that the missing item was tendered to the carrier. Accordingly, the settlement was affirmed.
