Highlights

A firm protested the Federal Highway Administration's (FHwA) refusal to approve a state contract award, contending that FHwA took over the procurement. GAO held that it would not consider the protest, since: (1) the state was not a federal agency; and (2) FHwA was only exercising its grant administration authority and was not substantially involved in the procurement. Accordingly, the protest was dismissed.
